The terms and conditions, policies and practices provisions contained herein, (This "Agreement"), applies to all applicants, clients and users of greenlightjobs (The "Company" or “greenlightjobs”) online recruitment website (The "Site"), and are incorporated within this document by reference. In this Agreement, the Terms "You and Your" will refer to either (The "Client, Employer, Customer, Applicant and/or User"). The Terms "We" and "Our" and "Us" refer greenlightjobs, the Company. Please read this Agreement carefully before agreeing to use the greenlightjobs website.
USERS OF THE WEBSITE

The following is intended to provide a sample list of Users of the Site; it is not all-inclusive:
Client, Employer, (together, "Client" or “Employer” or “You” or “you”):

Clients are defined as representatives who are either authorized to post, display or make offers of hire for "registered businesses" seeking to fill full-time, part-time, temporary, project or independent contractor work. For purposes of this Agreement, "registered businesses" shall mean all Clients who (a) are seeking to fill positions for; (b) have the right and authority to fill such positions; (c) accept this Agreement and are authorized to use the Site; and (d) are authorized and assigned an account password and account access by a Company representative.
Applicant, Job Seeker (together, "Applicant" or “Job Seeker” or “You” or “you”):

An Applicant, who is an individual of at least eighteen (18) years of age, may register to use the Site for the sole purpose of seeking employment on either a full-time, part-time, temporary, project or as an independent contractor basis.
All users of the Site are responsible for securing, at their own expense, any computer related hardware, software or service required in order to access and use this Site.

Referrals and transfers of information about applicants will not be made on a discriminatory basis. Clients are fully responsible for making their own employment decisions.
PAYMENT TERMS AND FEES

APPLICANTS:
Applicants seeking employment through the Company's Site are not required to pay a fee to seek a job and find a potential placement with an Employer. Applicants are permitted to complete a Free Online greenlightjobs’ Application Form and purchase a Premium Services package as outlined on the site. Applicants acknowledge and agree that the Company reserves the right to amend this policy at its discretion at any time, with or without notice. The Company also reserves the right to offer from time to time special promotions and amend the pricing accordingly.
Applicant acknowledges that he / she has read the General Terms and Conditions, Policies and Practices ("the Agreement"), and that use of the website constitutes formal agreement to be bound by all of the Agreement.
EMPLOYERS:
Employer’s are required to purchase a subscription membership package as outlined on the site. Employer’s acknowledge and agree that the Company reserves the right to amend this policy at its discretion at any time, with or without notice. The Company also reserves the right to offer from time to time special promotions and amend the pricing accordingly.
Employer acknowledges that he/she has read the General Terms and Conditions, Policies and Practices (“the Agreement”), and that use of the website constitutes formal agreement to be bound by all of the Agreement.
PRIVACY POLICY

GREENLIGHTJOBS is committed to protecting the privacy of its users. We want to provide a safe, secure user experience. Please read the following to learn more about how we treat information collected on the Site.
The Web is an evolving medium; we may change the terms of this Terms & Conditions from time to time. By continuing to use greenlightjobs’ online recruitment services, you accept any modifications to this Agreement, and, we may change, restrict access to, suspend or discontinue the greenlightjobs site, or any portion of the greenlightjobs site, at any time, with or without notice.
greenlightjobs collects personally identifiable information from Applicants and Employers when you register for a Site account, when you use certain products or services and when you enter promotions or contests that may be offered from time to time. We may also ask you for other information, such as information on your interests, your likes and dislikes regarding the Site, the types of jobs you are interested in, etc., in an effort to deliver to you the best possible Site experience.
As an Employer or Applicant, you should be aware that when you voluntarily display or distribute personal information (such as your e-mail address), that information could be collected and used by others. This may result in unsolicited messages from third parties for which the Company is not responsible.
We also collect an IP address from visitors to our Site. We use your IP address to help diagnose problems with our server, and to administer our Site. Your IP address is also used to help identify you when you visit our Site.
greenlightjobs may request that you submit feedback from time to time. Any feedback that is submitted becomes the property of the greenlightjobs.
In general, by using the Site or our services, you permit disclosure by the Company of personal information and other information you provide and we otherwise obtain to prospective Clients, other professionals, and third parties.
YOUR PERSONAL INFORMATION
We do not disclose your personal information, including your individual visits to our Site, or personal information that you provide, such as your name, address, e-mail address, telephone number, credit card number (if applicable), employment history and related information, etc. to any outside parties, except when we believe that such release is necessary to (i) match you with potential Employers and to help Applicants with job prospects, (ii) comply with law, (iii) enforce or apply the terms of any of our user agreements or, (iv) protect the rights, property or safety of greenlightjobs, our Applicants, our Employers, or others. But we may record and share aggregated information with our partners, member companies and employers. Also, if you input your information on a co-branded page, then your information becomes the property of both greenlightjobs and the co-sponsor of the page. In that instance, the use of your personal information by our partner company will be subject to the privacy policy of that company and greenlightjobs is not responsible for their use of your personal information.
We employ other companies and individuals to perform functions on our behalf. Examples may include recruiters, career counselors, and individuals or companies hosting our web servers, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. These other individuals or companies may have access to your personal information as necessary to perform their functions, but they may not share that information with any third party.
PERSONAL INFORMATION ON APPLICANT
JOB PROFILES, RESUMES AND PORTFOLIOS
Since greenlightjobs is an online recruitment website, we provide the Employer with options regarding the accessibility of your Applicant information for employment purposes:
1.By submitting an online application whether for free or by purchasing the premium services on the Site, you allow your information to be searchable without making it confidential I
2.You will not be able to apply or match to any openings posted by Employers onto the site in a confidential manner. Prospective Employers searching the database will be able to view your contact information.
3.You should never provide any non-job related personal information not contained within the employment application process, including but not limited to, social security number, information regarding ethnic or national origin, sexual orientation, marital status or any other personal information either online or over the phone.
4.You should never provide independent parties your credit card number or any bank or financial information or conduct any unsecured or unauthorized monetary transaction either over the phone or in person.
5.You are free to cancel or suspend your subscription to the services at greenlightjobs at anytime by contacting customerservice@greenlightjobs.com.
USE OF COOKIES
Cookies, which are small text files recorded in a user's hard drive, are employed by thousands of sites to enhance the user's Web viewing experience. Cookies cannot damage user files, nor can they read information from a user's hard drive. CREDIT CARD SECURITY
greenlightjobs employs an encryption for secure credit card transactions through a gateway and merchant account provider, Cybersource.
At greenlightjobs, we use the highest level of SSL encryption currently available to consumers through Cybersource. This ensures the safety and security of your credit card transactions. SSL ("Secure Sockets Layer") basically means that our server and your browser create and agree on an encryption key that will be used only for that particular session. Once established, this key encrypts all communication between our server and your browser. To ensure accountability to these security measures, we have a "server certificate" issued to us by Thawte. They are a trusted third party authenticator. The certificate allows for authentication and guarantees mutual protection as well. If you have concerns, or witness any questionable site activity or believe you are a victim of fraud, you should review your credit card agreement or call the company that issues your card to ask about its policies regarding liability for fraudulent Internet charges or, contact your local authorities, or you may email greenlightjobs for more information regarding online credit card transactions at customerservice@greenlightjobs.com so steps can be taken for your immediate safety.
OWNERSHIP

You agree that all rights to greenlightjobs or Site content, including but not limited to, logos, EVA Profile Assessments TM, patents, trademarks, licenses, software, services, host and service providers are reserved, and any reproduction in whole or in part, with or without our permission by prior written consent of greenlightjobs is strictly prohibited.
USE OF MATERIALS
All material you submit to greenlightjobs for purposes of employment consideration, including but not limited to any material on any of our Site’s forums and other public-posting areas becomes the property of greenlightjobs.com and may be reproduced, modified and distributed as we see fit in any medium and for any purpose. You warrant that all moral rights, if applicable, in any material that you submit to us have been waived.
CONSENT AND RELEASE
By submitting material to greenlightjobs, as an Applicant you automatically grant, or warrant that the owner of such material has expressly granted greenlightjobs the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. You hereby grant greenlightjobs.com the right to edit, copy, publish and distribute any material made available on greenlightjobs.
CONTENT
Although we make every effort at greenlightjobs to make the content freely accessible, we don't intend to give up our rights, or anyone else's rights, to the materials appearing on the Site. As an Employer or Applicant, you warrant and represent that the content you provide will not (a) include libelous, slanderous, defamatory content or contain pornography or be obscene or include profanity; (b) violate any laws or regulations; (c) misappropriate or infringe any trademark, trade secret, patent, copyright or other proprietary right whether public or private; (d) contain any computer related viruses or anything intended to intercept or cause irrevocable harm or damage to the Site or any data contained therein; (e) contain information which is deemed false, incomplete or inaccurate regarding you or any representation you may make.
As an Employer or Applicant, you agree that greenlightjobs makes no warranties as to the distribution, publication or use of the content you provide and that we may take any action deemed necessary and appropriate with respect to your content if there is reason to believe that your content might in any way create a liability for us, harm or cause negative business relationships with our service providers and customers, Applicants, Employers as a result.
As an Employer or Applicant, you grant a perpetual, royalty-free, irrevocable license to use, display, modify, and copy your content and intellectual property you provide for use on the Site.
greenlightjobs may from time to time contain links to other third-party websites as such, we do not make any endorsements as to the service, product, performance, integrity of information or content as it relates to these websites, and are therefore not liable for libel, defamation or obscenity, contained on such third-party website, or any violation of privacy, or any trademark, patent, copyright, or other proprietary right, relating to such third-party websites.

You hereby certify that the information provided is true and correct in every respect. You agree that any information and statements you provide for use on the Site, may be checked by Applicants, Clients, prospective employers, and any of their agents or representatives. Further, you release greenlightjobs, its Applicants, Clients, and any of their agents or representatives from any and all claims, losses, and liability for any damages that may result from use or furnishing of such information to the greenlightjobs, or the Site, or its Applicants, Clients, agents or representatives. You understand that any misrepresentation, falsification or material omission of information may negatively affect your job search or recruitment efforts, result in a failure to receive or make a job offer, or may result in the termination of your employment and / or continued relationship with greenlightjobs.
INDEMNIFICATION

By using the Site or our services, you are agree to indemnify greenlightjobs and its shareholders, related organizations, representatives, employees, customers, and business partners, (the "Company Representatives"), and you agree to hold greenlightjobs’ Representatives harmless from any and all damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, that you or your agents or may incur as a result of any actions, lawsuits, claims, or proceedings arising out of or in any way related to your disclosure of information, your breach of this Agreement, or your use of the Site and / or our services, including, without limitation, any claims or actions alleging defamation, misappropriation of trade secrets, intellectual property, infringement or any tort theory.
GENERAL RELEASE

In consideration of the use of the Site and / or services of greenlightjobs, you agree to conform to all existing standards and rules of the Company. You further agree to release greenlightjobs, its Representatives, Clients, Employers and Applicants from and against any liability resulting from or relating in any way to the use of the Site or the information provided to others. You understand that greenlightjobs is not involved in making recommendations regarding employment or making any employment decisions and is not involved in any transaction, relationship or potential relationship between and Applicant and any Client or other user of the Site. You agree that greenlightjobs will not be a party to any dispute that may arise between and Applicant and any Employer or other party and is not obligated to take any action or refrain from taking any action regarding any such dispute. If you have a dispute of any kind with any Applicant, Employer, Client, recipient of information or other party, you hereby release greenlightjobs and the Company’s Representatives from any and all claims, demands, causes of action, and damages, of every kind and every nature, whether known or unknown, that are related to any such dispute. This release includes all claims under Section 1542 of the California Civil Code. That statue provides as follows: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." You also agree that you are waiving all rights and benefits under any common law principle of similar effect or any statue in any jurisdiction.
ASSIGNMENT

You agree that by using the Site, and by the conditions outlined in this Agreement, that you may not assign this Agreement to any third party; any assignment will make this Agreement null and void. It is understood that the Company has the right to assign this Agreement without your consent. This Agreement will be governed in its entirety by the laws of the State of California and any action, proceeding or otherwise related to or arising from this Agreement will be brought in a federal court in the District of California and you freely submit to and agree to venue and jurisdiction.
ENFORCEMENT

This Agreement will be enforced according to the laws of the State of California. If any provision of this Agreement is held to be unenforceable or invalid for any reason, all remaining provisions will remain in force.
LIMITATION OF LIABILITY

In no event shall greenlightjobs or the Company’s Representatives be held liable for any indirect, incidental, exemplary, consequential or special damages, including but not limited to the loss of any information, data or profits, arising from or relating to the use of the Site or the services of the Company. In no event shall the cumulative liability in connection with the use of the Site or the Company's services exceed the greater of (a) One Hundred U.S. Dollars ($100.00); or (b) the total amount paid to the Company by the claimant within the last thirty (30) days prior to the rise of any action. The foregoing limitation of liability, whether by tort, contract or otherwise, for those states where limitations of liability are allowed, is cumulative with all payments satisfying the limits described herein.

GREENLIGHTJOBS IS NOT RESPONSIBLE FOR, AND CANNOT GUARANTEE THE PERFORMANCE OF, GOODS AND SERVICES PROVIDED BY OUR USERS, ADVERTISERS [OR OTHERS TO WHOSE SITES WE LINK. THIS AGREEMENT

We may amend this Agreement at any time, with or without prior notice to you and your continued use of the Site indicates your acceptance of any such amendment. We reserve the right to terminate this Agreement and immediately remove your information, at any time, with or without prior notice to you and for any reason. Without limiting the generality of the aforegoing, and in our sole discretion, if we obtain information regarding any activity that would be deemed a violation or breach of this Agreement, or an infringement of third party rights, we have the right to terminate this Agreement immediately without prior notice to you.
